New Delhi : In a significant legal victory, the Association for Protection of Civil Rights (APCR) successfully secured the discharge of two individuals, Mohd. Umar and Muddussir Faheem Hasmee, who were wrongfully accused in the 2019 Jamia violence case. The court ruled that the charges against them, based solely on mobile location data, were insufficient for prosecution.
The accused were booked under FIR No. 242/2019 in the case titled State Vs. Anal Hussain & Ors. However, there was no direct evidence—such as witness testimonies or CCTV footage—linking them to the incident. The prosecution relied solely on mobile location data, which the court deemed inconclusive as proof of criminal involvement.
APCR, through its legal team led by Advocate Deeksha Dwivedi, argued that suspicion alone cannot justify criminal charges. The court agreed, stating that mobile data, without corroborating evidence, cannot be the sole basis for prosecution. As a result, Mohd. Umar and Muddussir Faheem Hasmee were discharged from the case, along with several others, including Mohd. Adil, Roobul Ameen, Mohd. Jamal, Mohd. Shahil, and others.
