CJI Gavai Denounces ‘Bulldozer Justice’, Reaffirms Shelter as Fundamental Right

Chief Justice of India BR Gavai strongly criticised extra-judicial demolitions. He called them a clear violation of constitutional rights.
Speaking in Milan on Wednesday, he addressed a gathering. The theme was “Role of Constitution in Delivering Socio-Economic Justice in a Country: Reflections from 75 Years of Indian Constitution.”
CJI Gavai said the right to shelter is a fundamental right. It comes under Article 21 of the Constitution.
He referred to a recent Supreme Court ruling. The court held that demolishing homes of accused persons as punishment is wrong. It violates legal procedures and is arbitrary.
“Such demolitions breach the rule of law,” he said. “The executive cannot be judge, jury, and executioner.”
He explained that demolishing homes of accused persons causes collective punishment. It ignores the hard work and dreams behind owning a home.
He said socio-economic rights, like the right to housing, uphold dignity and equality.
“Constitutional guarantees must protect civil liberties,” he added. “They must also ensure dignity and well-being of the vulnerable.”
Reflecting on 75 years of the Indian Constitution, he called it a journey of ambition and success. He said it helped promote socio-economic justice.
But he warned that progress is impossible without addressing deep inequalities.
“Socio-economic justice,” he said, “is not just a constitutional goal. It is a real need for social stability and inclusive growth.”
