PRAYAGRAJ: The Allahabad High Court has stayed proceedings against three applicants accused in a Triple Talaq case, after their counsel argued that they belong to the Shia community, which does not recognise talaq-e-biddat. Justice Vikram D Chauhan issued notices to the opposite party and fixed December 12, 2025, as the next date of hearing.
The petition, filed by Shahid Raza and two others, sought quashing of the chargesheet filed on June 22, 2024, and the summoning order dated July 10, 2025, issued by the Additional Chief Judicial Magistrate. The counsel for the petitioners submitted that Triple Talaq, as defined under Section 2(c) of the Muslim Women (Protection of Rights on Marriage) Act, 2019, applies only to Sunnis, since Shia jurisprudence does not permit instant divorce.
According to the FIR, Raza allegedly pronounced Triple Talaq to his wife, who is the complainant in the case. The defence contended that the charge cannot stand since Shias follow a different interpretation of Islamic law.
In its order dated September 18, the High Court observed that the matter required detailed consideration. It directed the opposite parties to file a counter affidavit within three weeks. Until then, proceedings in the case will remain stayed.
