New Delhi, Dec. 15: Giving relief to the Waqf Cemetery Karbala Committee in the case of Dabri graveyard in the Dwarka court of South West Delhi, the court gave a historic verdict in the case against the defendant illegal committee and rejected its application.
In the application, the plaintiff Advocate Raees Ahmed informed the court that the property had been used for the burial of Muslims’ dead bodies for more than 100 years. The property is governed under the Waqf Act-1995 and Delhi Waqf Board issued NOC to the General Secretary of the plaintiff society for using the property for burial of Muslims’ dead bodies.
The dispute erupted when the plaintiff had taken the dead body of the caretaker of the existing graveyard for burial in the existing graveyard, the defendants and some other unknown persons restricted the plaintiff and threatened them of life if they came again for burial of any dead body in the existing graveyard.
The defendant illegal committee openly threatened to take over the possession of the property by parking the vehicles in front of the gate and inside the property and rearing cattle there. The defendant committee claimed that it was a private property. The plaintiff mentioned that the defendants are making every effort to take control of the existing graveyard land by illegal means.
After getting the case filed by the illegal committee dismissed, a case was filed by Advocate Raees Ahmed on behalf of the Waqf Graveyard Committee for permission for burial in the Big Graveyard.
The court, instead of considering this Waqf graveyard as private, declared it the property of the 100-year-old Delhi Waqf Board. The judgment came within three dates.
In this connection, the Waqf Committee of Dabri Graveyard today honored Advocate Raees Ahmed for this historic victory and also expressed gratitude to other lawyers of the legal team, NC Sharma, Shiv Kumar Chauhan, Pankaj Bhardwaj, Aslam Ahmed, Tariq Farooqui and others. The Committee Chairman Mohammad Iqbal, Vice Chairman Ahmed Ali and Mohammad Sultan, Anwar, Zaheer Khan, Mahfooz alias Pappu, and other members were also present.
