After APCR, Muslim League, SDPI Challenge Waqf Act in Supreme Court

New Delhi: Following the Association for Protection of Civil Rights (APCR), the Indian Union Muslim League (IUML) and the Social Democratic Party of India (SDPI) have now approached the Supreme Court with separate petitions challenging the constitutional validity of the Waqf Act 2025.

The IUML strongly criticised the Act, stating that it undermines the rights of minorities and alters the traditional framework for the creation, governance, and protection of Waqf properties—assets that are exclusively dedicated to Allah for religious or charitable purposes.

The party’s petition contends that the amendments passed by the Parliament, despite widespread opposition, enforce unjustified restrictions and state interference that undermine the core principles of Waqf. It argues that the Act is in violation of Articles 14, 15, 25, and 26 of the Indian Constitution, which safeguard equality, religious freedom, and the autonomy of religious institutions.

Similarly, SDPI’s Vice President Mohammad Shafi voiced concerns that the legislation represents a direct assault on the constitutional rights of Muslims. He expressed hope that the Supreme Court would intervene to uphold justice and protect the community’s interests.

Additionally, the influential Sunni organisation from Kerala, Samastha Kerala Jamiyyathul Ulema, has also filed a petition against the Act in the apex court.

The controversial Waqf Act, which claims to seek better regulation of Waqf properties, has faced mounting backlash from several quarters. Other petitions have already been submitted by the Jamiat Ulama-e-Hind, AIMIM chief Asaduddin Owaisi, and Congress MP Mohammad Jawed.

As legal and community battles intensify, all attention is now on the Supreme Court, with petitioners hopeful that the judiciary will uphold constitutional values and preserve the sanctity of Waqf in India.
