Lucknow: The Allahabad High Court has issued a landmark ruling, directing the DM of Moradabad to ensure the admission of children who were expelled from school for bringing non-vegetarian food in their tiffins. This decision follows a petition filed in response to the expulsion of children at a school in Amroha, Moradabad, for carrying non-veg food.
In September 2024, a third-grade student, along with his two younger siblings (in class 1 and kindergarten), brought non-vegetarian food to school. The school’s principal expelled all three children for this reason, disrupting their education. Despite their parents’ request for leniency, citing the children’s young age, the principal refused to allow their re-admission.
In response, the children’s mother, Sabra, filed a petition with the Allahabad High Court, arguing that the expulsion of her minor children was unjust and had a detrimental effect on their future. The High Court took up the case, scheduling a hearing for December 19. During the hearing, Sabra’s lawyer, Umar Zameer, argued that the expulsion violated the children’s right to education and criticised the principal’s actions as narrow and communal.
The High Court directed the DM of Moradabad to ensure that the three expelled children are admitted to another CBSE school within two weeks. The court further stated that if this order is not implemented, the DM must personally appear before the High Court on January 6, 2025.
This ruling brings hope to the children, who are now assured of being admitted to another CBSE school, ensuring the continuity of their education. Sabra, expressing her relief and gratitude, said, “God never does injustice. When you walk the path of honesty, God always helps. If my children made a mistake, they shouldn’t have been punished so severely. The High Court has done justice, and I am very happy.”
