Kozhikode: The Waqf Protection Committee reaffirmed on Friday that the disputed land in Munambam is owned by the Waqf Board.
Althaf, a representative of the Waqf Protection Committee, said here that the sale of Waqf land is prohibited, thus deeming the transaction of the Munambam land by the Farooq College Management Association as incorrect.
The college management association should be held accountable for the unlawful sale of land, he stated. In the meantime, the hearing regarding the Munambam Waqf land, which was brought before the Waqf Tribunal, has been postponed until December 6.
An appeal has been submitted by Farooq College, Kozhikode, the beneficiary of the alleged Waqf deed, contesting the Kerala State Waqf Board’s decision to classify the Munambam land as Waqf property. Due to the sensitive nature of the case, the judge prohibited media personnel from entering the courtroom at Eranhipalam in Kozhikode.
The state-level Waqf Samrakshana Samiti, along with the family of Mohammed Siddeeq Sait, who previously owned the 404-acre land at Munambam – later registered as ‘Muhammad Siddique Sait Waqf’ on September 25, 2019 – has also decided to approach the court with a request to be included in the proceedings.
The conflict originated in 2019 when the Waqf Board designated the land, which had been sold by the Farook College management, as Waqf property and recorded it in the Waqf register. This sale was also documented by the sub-registrar’s office. In response, Farook College contested the Waqf Board’s ruling before the tribunal, asserting that the land had been received as a donation. The tribunal is expected to render its final decision after hearing from all parties involved.
