Hind Rajab Foundation Urges India to Arrest Israeli Reservist Over Gaza War Crime Allegations

New Delhi: The Hind Rajab Foundation (HRF), a Belgium-based investigative organisation, has filed an urgent complaint with Indian authorities seeking the arrest of an Israeli national currently travelling in Himachal Pradesh. The organisation has approached the police, the Ministry of Home Affairs, and the Bureau of Immigration over allegations linked to actions in Gaza.

HRF stated that Eitan Gilboa, described as a reservist in the Israeli army, took part in the demolition of residential areas in Gaza and publicly documented those actions. The organisation submitted what it described as a detailed investigative report and argued that the alleged acts amount to war crimes under the Geneva Conventions Act, 1960.

The foundation said India, as a signatory to the Geneva Conventions, carries obligations under Article 146 to search for and prosecute individuals accused of grave breaches, irrespective of nationality.

Dyab Abou Jahjah, General Director of HRF, urged Indian authorities to take immediate action. He alleged that Gilboa publicly recorded and celebrated the destruction of residential neighbourhoods in Gaza and shared material showing explosive demolitions of civilian structures.

According to a statement issued by the organisation, Gilboa was born in Gaza and later left with his family after Israel’s withdrawal from the territory. HRF claimed that after October 2023, he returned to Gaza with the Israeli army and documented demolition operations in areas including Khan Younis and Rafah. The organisation said videos and photographs linked to these actions later appeared on social media.

Natacha Bracq, Head of Litigation at HRF, argued that the allegations meet the legal definition of war crimes under Indian law and called for prosecution.

The filing forms part of HRF’s wider legal campaign, which has generated more than 90 criminal complaints across 30 jurisdictions worldwide.
