Supreme Court to Hear Custodial Torture Plea Against Gujarat Police

New Delhi: The Supreme Court has agreed to hear a plea alleging custodial torture and sexual assault of a 17-year-old Muslim boy, Aryan Makhiala, by Gujarat Police. The matter has been scheduled for September 15 before a bench headed by Chief Justice B R Gavai and Justice K Vinod Chandran.

The petition was filed by the boy’s sister, who sought an independent investigation. She demanded either a Special Investigation Team excluding Gujarat police officers or a court-monitored CBI probe.

According to the petition, Aryan was detained by Botad Town Police from August 19 to 28 in connection with a gold and cash theft. During this period, he was allegedly subjected to severe beatings and sexual assault, including the insertion of sticks into his anus. The plea states that the police failed to produce him before a magistrate within 24 hours and did not conduct a medical examination as required under law.

The petitioner has requested registration of an FIR under the Bharatiya Nyaya Sanhita, the Protection of Children from Sexual Offences Act, and the Juvenile Justice Act. She also urged the court to order preservation of CCTV footage from the police station and to obtain medical records.

The plea further seeks the constitution of a medical board at AIIMS, New Delhi, to assess injuries, and demands financial support for counseling, treatment, and compensation.

The Supreme Court’s decision to list the case signals judicial concern over alleged violations of child protection laws and custodial rights.
