SC Ruling on UP Madrasa Education Act 2004 Encouraging for Minority Communities: Dr. Malik Faisal

Lucknow: Dr. Malik Faisal, Ameer of Jamaat-e-Islami Hind, Eastern UP, has welcomed the Supreme Court’s recent ruling upholding the Uttar Pradesh Madrasa Education Act 2004. In a statement to the media, he expressed his appreciation for the decision, which overturned a previous Allahabad High Court verdict that had deemed the Madrasa Act unconstitutional.

He stated, “The Supreme Court’s ruling is encouraging for minority communities in the state. It supports the preservation and advancement of their educational rights, while safeguarding the educational rights of madrasa students and protecting the educational institutions of religious minorities.”

Dr. Faisal emphasised that this ruling reinforces the constitutional principles that ensure protection for educational institutions run by religious minorities.

He noted that the Supreme Court’s decision also sends a clear message to the state government to respect the right of religious institutions to provide both religious and modern education in line with their unique identity. He added that while the government can offer assistance to madrasas, it should refrain from undue interference.

In light of the decision, Dr. Faisal highlighted the challenges faced by Islamic madrasas, which are often politicised, and stressed the importance of this ruling in such a context.

“We urge the government to promote a better educational system that provides equal opportunities for all sections of society, rather than targeting madrasas,” he concluded.
