New Delhi: The Supreme Court has issued strong guidelines to curb dowry-related violence, calling the practice a grave constitutional and social failure cutting across religious communities. The ruling came while restoring the conviction of a husband and his mother for the dowry death of a 20-year-old woman in Uttar Pradesh.
A Bench of Justice Sanjay Karol and Justice NK Singh overturned an Allahabad High Court verdict which had acquitted the accused despite trial court findings. The woman was set ablaze after her family failed to meet demands for a television, a motorcycle, and cash. The Court held the High Court ignored settled principles under dowry death and cruelty provisions of criminal law.
The judgment traced the evolution of dowry from a voluntary practice to a coercive system tied to social status and marriage negotiations. It linked the practice to hypergamy, caste hierarchy, and patriarchal control, noting how education, income, and profession of grooms now dictate financial demands.
The Court examined Muslim marriages in detail, noting dowry holds no sanction in Islamic law. It highlighted the distortion of mehr, a mandatory obligation meant to secure a woman’s financial independence. The Bench observed mehr often stands reduced to a token amount, while large transfers move from the bride’s family to the groom. This inversion strips mehr of its protective purpose.
The ruling warned this dual practice places heavy financial strain on families and increases risks of harassment, domestic abuse, and dowry deaths. It weakens women’s security during divorce or widowhood.
The Court stressed dowry violates constitutional guarantees of equality, dignity, and life. It described eradication of dowry as an urgent constitutional duty requiring firm legal enforcement and social accountability.
