In a key ruling, the Supreme Court of India has issued an interim order halting all demolition actions, often termed “bulldozer actions,” across the country without its prior approval. This order follows petitions accusing state governments of using demolitions as a retaliatory tool against individuals accused of crimes. The court, however, clarified that demolitions of unauthorized constructions on public spaces such as roads and footpaths will not be affected by this stay. The matter will be heard again on October 1, reported the Live Law.
Solicitor General Tushar Mehta raised objections, arguing that halting demolitions may hinder lawful actions against illegal structures. Justice BR Gavai responded, emphasizing that suspending demolitions for two weeks would not cause any harm. The petitioners, led by Senior Advocate Chander Uday Singh, highlighted that demolitions were being carried out as a form of collective punishment, particularly against minority communities.
The court invoked Article 142 of the Constitution, emphasizing the importance of due process. This development stems from a series of petitions filed in 2022, challenging demolitions in Delhi’s Jahangirpuri after communal violence. The court’s ruling sets a new precedent for the regulation of demolitions and executive actions, sparking discussions on balancing law enforcement with constitutional rights.
